Tekonsha® Engineering Company (the "COMPANY") warrants its products to be free from defects in material and workmanship under normal use and service for a period of one year from the date of the sale to the first purchaser at retail of the vehicle on which our products have been installed by a manufacturer; or, if purchased directly by a first consumer, then for a period of one year after the date of such purchase by a first consumer from a dealer. Note the following exceptions: Brake Controls 9030 Voyager®, 9035 Voyager® XP, 9040 Envoy®, 9045 Envoy® SX, 9055 Sentinel™, 9010 Commander®, 9020 Commander® XP, 80520 Concord IAS™ are for a period of five years; Brake Controls 80550 Pilot®, 80510 AccuTrac®, 80516 AccuTrac® SX, 80500 POD® are for a period of three years.

The obligation of the COMPANY under this Warranty shall be limited to replacing or repairing, in the COMPANY'S discretion, at the COMPANY'S plant and at its expense, those products which shall be demonstrated to the satisfaction of the COMPANY, to be defective in material and/or workmanship, within sixty days from the date of receipt of such products by the COMPANY.

This Warranty shall not extend to any of the COMPANY'S products or any parts thereof which have been improperly installed, installed contrary to the COMPANY'S instructions, or altered, or tampered with, or the engineering and design of which have been changed in any way; nor shall it extend to any defects arising from abuse, misuse, accident, or negligence of an installer or of the consumer. This Warranty shall extend to plastic products only if they are used under normal heat and cold conditions.

THE COMPANY SHALL NOT BE LIABLE FOR CONSEQUENTIAL DAMAGES, SUCH AS LOSS OF USE OF VEHICLE, RENTAL OF SUBSTITUTE VEHICLE, LOSS OF TIME, LOSS OF WORK, INCONVENIENCE, TRANSPORTATION EXPENSES, TELEPHONE, LODGING, LOSS OF REVENUE, LOSS OF AND/OR DAMAGE TO PERSONAL PROPERTY, FOR, OR ARISING OUT OF BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OF ITS PRODUCTS. ALL EXPRESS AND IMPLIED WARRANTIES OF OUR PRODUCTS, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS, SHALL TERMINATE AND EXPIRE ONE YEAR AFTER THE DATE OF THE SALE TO THE FIRST RETAIL PURCHASER OF THE VEHICLE ON WHICH THESE PRODUCTS WERE INSTALLED BY THE MANUFACTURER; OR, ONE YEAR AFTER THE SALE OF OUR PRODUCTS TO A FIRST CONSUMER BY A DEALER (WITH THE EXCEPTION OF CERTAIN BRAKE CONTROLS AS PREVIOUSLY LISTED). SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. FURTHER, SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES AND OF ALL OTHER OBLIGATIONS OR LIABILITIES ON THE PART OF THE COMPANY. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. NO DEALER, DISTRIBUTOR, EMPLOYEE OR REPRESENTATIVE OF THE COMPANY IS AUTHORIZED TO CHANGE THIS WARRANTY IN ANY WAY OR TO GRANT ANY OTHER WARRANTY.

The first retail purchaser of the vehicle, or the first consumer, as the case may be, shall remove any product which he claims to be defective and deliver the same to the dealer from whom he purchased the vehicle or product, with instructions to forward the same to the COMPANY. In the event that the return of a product to the dealer from whom he purchased the vehicle or product, should be impractical, said retail purchaser or consumer shall contact the Customer Service Department of the COMPANY at its home office at 101 Spires Parkway, Tekonsha, Michigan 49092, directly for instructions as to any other location to which he may return the product. The cost of removal, the cost of forwarding of the product to the COMPANY, the cost of the return of the product by the COMPANY, and the cost of reinstallation of the products in the retail purchaser's or consumer's vehicle shall be at the expense of the retail purchaser or the consumer. This Warranty shall extend only:

(a) to the first purchaser at retail of the vehicle on which the COMPANY'S products have been installed by a manufacturer, and not to any subsequent owner; and (b) to the first consumer who purchases our product from one of our authorized dealers, and not to any subsequent party; and is not transferable.
